General Terms and Conditions – Eva Boonman Designs shop

By placing an order through Eva Boonman (hereinafter "we," "us," or "our"), you unconditionally accept these terms and conditions. If you do not agree with any part of these terms and conditions, please do not place an order.

1. Orders and Agreement

1. An agreement will only be concluded after we have confirmed and shipped your order.
2. We reserve the right to cancel or refuse orders without giving any reason.
3. You are responsible for providing the correct information (size, color, delivery address, etc.). We are not responsible for any errors in this information.

2. Product Information and Images

1. All product images and descriptions are for illustrative purposes only. Colors, dimensions, or finishes may vary in actual product.
2. Typographical errors, pricing errors, or product description errors may entitle us to cancel orders.

3. Customization and Personalized Products

1. Our products are often specially produced to order and are unique, which makes this cannot be returned or cancelled.
2. By placing an order you acknowledge that it cannot be changed once production has started.
3. We work together with Printify for production and shipping. Their terms and conditions also apply: https://printify.com/terms-of-service/.

4. Prices and Payments

1. All prices include VAT (unless otherwise stated) and exclude shipping costs.
2. We reserve the right to change prices, even after an order has been placed, if there are obvious errors.
3. Payment must be made in full and in advance using the available payment methods.

5. Delivery and Shipping

1. Delivery times are indicative and not binding. Exceeding a delivery time does not entitle you to compensation or cancellation.
2. The risk of loss or damage to products passes to you when the product is delivered to the carrier.
3. Any customs charges or taxes are the responsibility of the customer.

6. Returns Policy

1. All our products are Print on Demand products and are excluded from returns and refunds. (in accordance with Article 6:230p sub f BW).
2. Return costs are fully borne by the customer.
3. We do not accept returns without prior notification.

7. Limited Warranty

1. We only guarantee that our products will conform to the product description at the time of delivery.
2. We offer no guarantee with normal use, wear and tear, incorrect washing or incorrect use of the product.
3. Our obligation in the event of a defect is limited to, at our option: (a) replacement of the product, or (b) refund of the purchase price.

8. Full Disclaimer of Liability

1. We are not liable for any direct, indirect, consequential, or exemplary damages, loss of profits, loss of data, emotional distress, or other damages arising from the use of, or inability to use, our products.
2. Our total liability, in whatever form, is limited to the amount you paid for the product.
3. We are not liable for any damage caused by third parties, production errors by suppliers (such as Printify), or delays in shipping.
4. You use our products entirely at your own risk.

9. Exclusion of Consumer Claims

1. To the extent permitted by law, Eva Boonman Designs excludes all consumer rights resulting in claims for damages or refunds outside the terms and conditions described herein.
2. We are not responsible for any personal injury, allergic reactions, or other discomfort caused by using our clothing or accessories.

10. Force Majeure

1. We will not be liable for any delay or failure to perform if this is due to circumstances beyond our control (such as natural disasters, pandemics, transportation problems or supplier disruptions).

11. Intellectual Property

1. All texts, images, logos, designs, and other content are the property of Eva Boonman Designs and may not be used without our permission.

12. Applicable Law and Disputes

1. These terms and conditions apply exclusively Dutch law applicable.
2. Any disputes will be settled exclusively by the competent court in the district where Eva Boonman Designs is established.
